How to handle client request for paperwork (FMLA, disability, etc.)

"Overcomers Counseling is focused on providing therapeutic treatment. While we can provide a treatment summary detailing your diagnosis, dates of service, and progress with your written consent, we generally do not complete formal disability or FMLA (Family and Medical Leave Act) certification paperwork, nor do we provide opinions on your capacity to work or function for legal or insurance purposes.

The determination of disability requires a specific type of evaluation (e.g., a Residual Functional Capacity assessment for Social Security), which is outside the scope of our clinical practice. These evaluations are often time-consuming and involve different expertise than ongoing therapy.

If you require disability benefits or formal leave certification, we can provide a referral to a qualified professional, such as a psychiatrist or a specialist who performs these specific evaluations, or you may be able to obtain the necessary forms from your primary care physician.

As with all healthcare decisions, it is your responsibility to pursue these appropriate avenues to meet your needs. Please note that Overcomers Counseling has a strict policy against providing treatment for the sole purpose of assessing disability benefits.

What should the clinician do?

The clinician can write a treatment summary for the client and refer them to a psychiatrist or psychologist to complete the necessary evaluations for FMLA paperwork.
